TERMS AND CONDITIONS OF SALE

Welcome to Tapkart!


The terms and conditions of sale as set out herein (“Terms of Sale”) constitute an agreement between Tapkart Convenience Private Limited (“we”, “us” or “our”) which is listed as the seller on the portal and its corresponding mobile application (collectively, “Platform”) and you (“you” or “your”) and govern your purchase of the products (“Product(s)”) from us through the Platform. By placing an order for any Product with us or making a purchase of Product, you expressly agree to be bound by these Terms of Sale. 


The Platform through which the Products are listed is owned and operated by Bazaarindia Technology Private Limited (“Parent Entity”). The Parent Entity acts solely as a technology platform provider and does not engage in the sale of Products. All Products are sold by Tapkart in its capacity as the seller-on-record.


These Terms of Sale are in addition to various agreements, Service Terms, Privacy Policy, Terms of Use and all other policies of the Platform. These Terms of Sale constitute an electronic record within the meaning of the applicable law. This electronic record is generated by a computer system and does not require any physical or digital signatures. 










Orders once placed may be cancelled only if permitted by Tapkart, and any cancellation request may be accepted or rejected at Tapkart’s discretion. Tapkart may cancel any order in case of suspected fraud, breach of these Terms, product unavailability, pricing or technical errors, or for reasons beyond Tapkart’s control. In case of permitted cancellations, refunds, if applicable, shall be processed in accordance with the Return and Refund policy below. Tapkart reserves the right to suspend access to the Platform or cancel orders of users found to be in violation of these Terms.

 


Products once delivered are non-returnable and non-refundable, except where the Product is defective, damaged, expired, incorrectly delivered, or where a specific return/refund policy for the Product expressly permits the same. Any approved return or refund shall be subject to the applicable Product policy, timelines, and verification requirements, including submission of proof where requested. Refunds, if approved, shall be processed within a reasonable time through the original payment method or in the form of credit, coupon, or promotional code, as determined by us. No refund shall be provided where delivery or fulfilment fails due to incorrect details, unavailability, or any reason attributable to the user. 



We list availability information for the Products on the relevant webpage of the Platform. Beyond what we say on that webpage or otherwise on the Platform, we cannot be more specific about availability. Please note that dispatch estimates are just that. They are not guaranteed dispatch times and should not be relied upon as such. As we process your order, you will be informed by e-mail if any Products you order turn out to be unavailable or out of stock.



We arrange shipping and delivery of Products through service providers, including through arrangements facilitated by our Parent Entity. Delivery timelines displayed on the Platform are estimates only and are not guaranteed delivery dates. Delays may occur due to courier issues, weather conditions, operational constraints, or events beyond our control. You are responsible for providing accurate and complete delivery details. We shall not be responsible for failed delivery due to incorrect address, unavailability of the recipient, refusal to accept delivery, or any other reason attributable to you.



Risk in the Product shall pass to you upon delivery to the address provided at the time of placing the order. 








All payments for orders on the Platform shall be made in Indian Rupees using the payment methods made available at checkout, including card, net banking, UPI, cash on delivery, or other RBI-permitted modes, as may be enabled from time to time. Payments are processed through third-party payment service providers and licensed payment aggregators. Such payment integrations may be facilitated by our Parent Entity. Tapkart facilitates electronic payments through such third-party payment service providers and is not a banking or financial service provider. By using a payment method, you represent that you are authorized to use such payment instrument and agree that any applicable transaction charges imposed by the payment provider or issuer shall be borne by you. 



You acknowledge that there may be licenses/permissions required under the applicable laws to use, purchase or otherwise possess certain Product(s). You will be solely responsible for obtaining such licenses/permissions and complying with the terms of such licenses/permissions. 



Prices are inclusive of applicable taxes, unless stated otherwise. The applicable tax amount will be shown at checkout, as required under Indian law. You shall be responsible for payment of all fees/costs/charges associated with the purchase of Products from us and you agree to bear any and all applicable taxes. 



Only persons who can enter into legally binding contracts as per Indian Contract Act, 1872, i.e., persons who are 18 years of age or older, are of sound mind, and are not disqualified from entering into contracts by any law, can use the Platform and place an order with us. If you are a minor i.e., under the age of 18 years, you may purchase the Product on the Platform only with the involvement of a parent or guardian.



In no event, our aggregate liability, if any, that is proven and ordered by a court of competent jurisdiction pursuant to a claim by you or person acting on your behalf, shall extend beyond the refund of money charged from you for purchases made pursuant to an order under which such liability has arisen and been established. We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when a contract for the sale of Product by us to you was formed.



We reserve the right to make changes to our policies, and these Terms of Sale at any time. You will be subject to the policies and Terms of Sale in force at the time you order Products from us, unless any change to those policies or these Terms of Sale is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.



We will not be held responsible for any delay or failure to comply with its obligations if the delay or failure arises from any cause which is beyond our reasonable control.



No provision in these Terms of Sale will be deemed waived and no breach excused, unless such waiver or consent is in writing and signed by us. Our consent to, or waiver of your breach, whether expressed or implied, will not constitute consent to, waiver of, or excuse for any other different or subsequent breach.



These Terms of Sale, all transactions consummated between you and us, and our relationship with you is governed by the laws of India, without reference to any conflict of laws principles and subject to exclusive jurisdiction of the courts at Bengaluru.
